| In recent years, air pollution of Beijing is serious. The air quality of Beijingcontinued to deteriorate. The index of pm2.5goes to the threshold. Lots of AQI isserious, too. The pollution level of Beijing reaches six. In this situation, thegovernment takes many measures, for examples, they adjust the industry’s structureand advance the non-polluting energy. They control the sources of pollution and shutdown enterprises which produce pollution. They restrict excessive vehicle’s accessand eliminate polluting vehicles. They improved the deterioration of air pollution inBeijing through these measures. However, Aircan move and it is unstable. We can’tuse point sources and small-scale non-point source to obtain proper results. We shouldgive up the traditional modes. China has recognized the importance of regionalcooperation to control air pollution. The Olympics in Beijing and the World Expo inShanghai found a mechanism for inter-regional cooperation of control of air pollution.This initiate is effective, but it is can’t be sustainable. This article want to find out ifBeijing and its surrounding areas should be implemented joint prevention and controlof air pollution and find out how to implement it, as well as the legal issues in theimplementation process should be noticed.This paper is divided into five parts, the first chapter is the necessity of regionalcooperation and legal basis of it in Beijing and its surrounding areas. I analyzed thecurrent condition of air quality in Beijing and I find out that Beijing and itssurrounding areas are regional areas. I conclude that the measure of joint preventionand control of air pollution is essential. The second chapter is the legal status of jointprevention and control of air pollution in Beijing and its surrounding areas. Idescribe the current level of provision of joint prevention and control of air pollutionfrom national law to the law of local. We can find the current content of jointprevention and control of air pollution and we can find deficiencies of it, too. Thethird chapter is legal challenges in implementation of joint prevention and control ofair pollution, the question of joint prevention and control of air pollution is that thelegislative system and plan of law are not perfect, management and system should beimproved, mechanism of them should be strengthened, and we can’t find aresponsibility for it, too. I made a cautious analysis of these issues. The forth chapterdepicts legislative experience. It describes specific legal measures of the United States and the European Union. It depicts the successful experience of the Olympic Gameswhich hold in Beijing and World Expo which hold in Shanghai. The fifth chapterdepicts the countermeasure I raised for regional joint prevention and control of airpollution. I made suggestions through these useful examples. First, we shouldimprove the legislative system. Second, we should found the management and thesystem of regional joint prevention and control of pollution. Third, we should found along-term mechanism of joint prevention and control. Forth, we should fulfill subjectsand responsibilities of joint prevention and control. |
