Xi'an High-tech Development Zone, The Land Requisition System Innovation

As the perfection of socialist market economy system in China, the land requisition system, formed in the period of plan economy, has gradually become unsuitable to the present situation. Its inadequateness can be manifested in the following four aspects: (1) the confusion in land requisition; (2) the deficiency of compensation payment; (3) the inappropriateness in the allocation of land requisition payment; (4) the monotonousness of arranging farmers after their land being taken over. The above problems are derived in fart from the lack of absolute enforcement of regulations related to the land management law as well as from the imperfection of the current land requisition system.To the above problems, Xi'an High-tech Developing Zone has come up with a succession of reforms and innovations in exploration and practice by connecting its practical situation in the past 14 years. Therefore, this paper is the summary to the jobs conducted by the Land Storage Center of Xi'an High-tech Developing Zone in taking over the lands of 12 villages during the past 3 years and we believe that there are four successful aspects requiring our attention. Firstly, the land requisition compensation payment should be improved. The compensation payment is determined by referring to the position and plan of the land and its production capacity. Secondly, the contract land requisition should be combined with announcement land requisition. The villagers can enjoy the subject status and the right of being informed and to negotiate. Thirdly, the land requisition should be connected with the land storage. By separating the land for requisition and the land offered, the government subject status during the process of land requisition is assured; the government function to serve for the enterprise is enhanced and the government macro-planning capacity is strengthened. Meanwhile, by including the commandeered land in the city storage land and exploiting them in a uniform way, the time period for the enterprise to obtain land can be shortened. Finally, to diversify the arrangement of the farmers: the farmers should be offered the right to choose the arrangement way voluntarily; currency can be used to lead farmers to the market and cultivate them the self - regulating capacity in market economy; to solve the land - commandeered farmers' lives in the long run, a certain stated - owned land can be remained to let farmers to participate in market and operation and to achieve the expected economic profits.Through summarizing the achievement of the land requisition policies in Xi'an High - Tech Developing Zone, the paper, meanwhile, brings forward some suggestions to further perfect the current land requisition policy.
