Research On Mechanism Review Of The Major Economic Activities Intellectual Property

At present, China’s enterprises frequently encountered blocking of the Westerndeveloped countries in intellectual property in international competition. Compared withother countries, there is a huge gap on development of independent intellectual propertyrights, the use international intellectual property and protection rules. The gap has beendeeply affected the process of China’s economic development. In the wave of globaleconomic integration, China is also actively integrating with the international standards,but the lack of intellectual property protection and the ability of use lead us at adisadvantage in the fierce international competition. At the same time, in recent years,frequently facing rounds of offensives launched against intellectual property rights inChina by multinational enterprises of many developed countries, we seem lack capacityto respond. Our government has realized this crisis, in order to break the premeditatedlayout of the Western developed countries, the intellectual property review has beenimproved to be on the strategic level, and also made it clear in the National IntellectualProperty Strategy Outline, which was released on June5,2008. Long-term Science andtechnology Development Plan (2006-2020) describes the goal of establishing the reviewsystem of intellectual property rights.Based on this background, all regions have introduced a local intellectual propertyreview policy. However, because our intellectual property newly developed thirty-oddyears, there is inevitably some missing in the host policy, which inevitably results in theimperfections of the current intellectual property of their respective administrative areas.In this paper, a comparative study of existing intellectual property rights review policiesof the administrative regions at all levels of the country has been conducted, analyzed thecause of the problem of its existence, and from a theoretical point of view, make aframework of intellectual property rights review system, to seek the best solution of China’s intellectual property system problems.
