A Study On Compliance Of Photovoltaic Industry’s Subsidy Policies In China

Governments around the world give the photovoltaic industry lots of subsidies, including our government. As95%of our photovoltaic products are exported, under the regulation of SCM agreement, the subsidy policies in our country have disadvantages in the international trade. The disadvantage appeared in the case of countervailing investigation of US to the photovoltaic products from China.This thesis selects the case, which has got great attention all over the world, as the conductor to reveal the problems in our subsidy policies. We focus on the subsidies which had been sued in this case, introducing the specific process, to get the enlightenment of this case, that we should optimize the subsidy policies of photovoltaic industry in China.Then, the thesis adopts the method of comparative analysis to research the compliance issues of photovoltaic industry’s subsidies in our country, comparing them with the regulations of the SCM agreement. After the comparation, the thesis analyzes the reasons why other countries make countervailing investigations to China. Also, we can get the internal reasons that why China suffered the anti-subsidy investigations, including the unreasonable design of government subsidies, and relying on the subsidies of the enterprises with the lack of planned completion.At last, the thesis suggests the whole subsidy policies to get well designed according to the analysis. For the specific subsidy policies, the prohibitive subsidies should be repealed immediately, and the other noncompliance subsidies should be optimized. For enterprises, they should follow the market’rules, and promote the integration of this industry. And when facing the unreasonable investigation of subsidies, we should resort to the WTO mechanism to protect our lawful rights.
