The state-owned assets in the administrative organs and institutions are thematerial basis of public products and services provided by the government.Theoretically speaking, they should be unproductive and nonprofit. But the fact is notso. Because of the lack of legal restriction and effective supervision, in thedepartmental profits and personal profits, the administrative organs and institutionsbegan to use the state-owned assets to participate in operating activities. So theadministrative organs and institutions operating state-owned assets appeared, and thescale has being continually expanding. They have deviated seriously from theorientation of the government functions, destroyed the image of government.Therefore,we must reform as soon as possible,make the government asset retreatingfrom the competitive field, and achieve the functions of government in the "homing".The reform of administrative organs and institutions operating state-owned assets hasimportant and far-reaching political and social significance.On the basis of fully collecting and reading related literature and researchachievements, the author tries to search and study some relevant theories, includinggovernment function theory, modern property-right theory and principal-agent theory.Then, this paper starts from the concept of the administrative organs and institutionsoperating state-owned assets, and has a brief review on the history of their productionand development. Taking Yunnan provincial administrative organs and institutions asan example, the administrative organs and institutions operating state-owned assetsare divided into three categories: leased assets, alone-operated assets and investedassets. The author analyses deeply the status about assets, management and personnel,compares respectively main economic indicators. Using relevant theories, The authoranalyses a series of problems arising there from. These problems mainly include: thegovernment function "offside", the rules of the market confusion, poor operatingefficiency and corruption phenomenon. In order to fully learn the experience in public assets management from foreign developed country and the achievement in theadministrative organs and institutions operating state-owned assets reform from someprovinces and cities, the author researches public assets management models ofAmerica, Canada, Australia and Japan and the achievement in the administrativeorgans and institutions operating state-owned assets reform models of Guangxi,Sichuan, Guangdong.On the basis of the empirical analysis and theoretical research, the author proposesthe goal of the administrative organs and institutions operating state-owned assetsreform. It is that the administrative organs and institutions should be completelyseparated with the operating state-owned assets and gradually withdraw from themarket competition. Through the reform, we can create the market environment offair competition, truly realize the governmental function homing and the value ofstate assets. In order to push reform smoothly, we should adhere to five principles.The first is open, fair, justice. The second is true, security and integrity. The third isthe guarantee to perform functions. The fourth is being divided into categories anddisposed step by step. And the fifth is prominent key and advance steadily. InSpecific reform measures, first of all, we must establish and perfect the legal systemabout the administrative organs and institutions state-owned assets management, anduse the law to forbid the operating activities of the administrative organs andinstitutions. On the base of Legislation, we should improve the property rights andconcentrate the management rights. After screening and transferring assets, surplusassets will be divided into categories and disposed of step by step. The primary waysabout asset disposal should be public auction and gratuitous transfer. For some assets,we can dispose of them by agreement transfer.
