With the development of China’s economic, road freight traffic is increasing and theroad transport overloading widespread. The road freight market is information asymmetricand structure fragmented. The carriers increased the volumes of shipping by illegaloverfreight for illegal profits. The overloading transportation disrupts road freight marketorder, generates great externalities while it increases freight volume. To meet therequirements of materials circulation of economic development in the modern social. TheOpinions On Strengthening Road Safety Work which was published by the State Councilpropose that the study of overloading shall be put into the scope of criminal law to ensure theroad safety and free-flow. It is worthy of research on the influence and effects of criminal lawregulating overloading on road freight economic system.This paper analyzes the influence and effects of criminal law regulating overloading onroad freight economic system by three main elements that is economic, legal, social. In theperspective of economic, criminal law regulating overloading destroyed the balance of supplyand demand of the road transport market and obstruct the development of country materialscirculation even though speed up the development of the organization and structure of thefreight market. In the perspective of legal, criminal law regulating overloading is conduciveto the maintenance of road freight market order. In the perspective of social, criminal lawregulating overloading can reduce the externalities of road freight and make conducive to thesustainable development of society. At last, criminal law regulating overloading should not bepublished for our current national conditions.
