Problems And Countermeasures On Land Violations Of Ganzhou City

Content: As the way to achieve the national land management functions and thenecessary method to ensure the full implementation of the land management laws andregulations,the land law enforcement supervision has become the more and more importantpart of land and resources management. Grasping the rule of illegal land use correctly,analysising the reasons and presentation of illegal land use in-depth are very important inthe prevention, suppression, and land violations to the land law enforcement supervision,maintaining the normal order of land management. With the rapid development of thesociety and economy of Ganzhou City in twenty-first century increased the rapid demandfor land, the tasks of strengthening the land law enforcement supervision and preventingand stoping the illegal land use are more urgent. This research in Ganzhou City is base on2009-2011land wei-chip law-enforcement inspection, through the analysis of the quantity,the form and the reasons of the illegal land use, putting forward the preventivecountermeasures of illegal use of land, as to provide positive reference for the maintenanceof the normal order of land management in Ganzhou city.The results show that:(1) the number of illegal land use cases is an upward trend, butthe illegal land area decreased, the illegal land towards fragmentation direction, in2009-2011years, the average of every illegal land area in Ganzhou is28.61mu,23.41muand7.21mu. Illegal use of farmland area decreased significantly, the illegal use of landinvolved in the area of cultivated land by1558.92mu in2009, fell to1216.97mu in2010and439.95mu in2011.(2) the illegal land mainly mining warehouse land andtransportation land, accounted for40.22%and20.96%of the total land, the concentratedexpression of illegal type is "not reported that" and "margin", respectively of the total landratio of74.25%and25.75%. According to the analysis of typical cases, the study found,Ganzhou’s illegal land use’s main reason include the defects of current land managementsystem, the lack of the rural land management function, the main driven by interest tooccupy the land, one-sided pursuit of a task from illegal land, law enforcement supervisionpersonnel is not perfect, the law enforcement is also not enough.Finally, it puts forward some countermeasures and suggestions for illegal landprevention to Ganzhou City: strengthening dynamic illegal in key regional; responsibilityto individual, stricting major illegal land use approval procedures; strengthening the propagandize of legal system, raising the awareness of the law;bringing the protection ofarable land and intensive use of land and other content into the local governmentperformance evaluation system; strengthening prevention and supervision work to stop theillegal phenomenon from the source; giving full play to the supervisory role of the generalpublic.
