Analysis On Illegal Land Use In W City Of Zhejiang Province And Countermeasures

Because of China's fundamental realities of more people but less land and low per capita cultivated land occupancy,it is an objective requirement to Strengthen land law enforcement supervision,to intensify land resource management,and to strictly protect cultivated land and promote the intensive use of land resources.However,with the acceleration of our country's urbanization,the development of productive forces and the improvement of people's living standard,the contradiction between supply and demand of land resources becomes more and more prominent.The problem of illegal use of land activities cannot be solved despite repeated prohibition."Difficult to stop,difficult to investigate,and difficult to implement" becomes a big problem for the land resources law enforcement workers.Through the systematic empirical analysis of illegal land use,we can make a thorough understanding of the current situation and causes of illegal land use at the present stage which can help to put forward effective countermeasures to prevent and control illegal land use.In recent years,the law enforcement inspection taking advantage of satellite remote sensing technique to monitor land use,has provided technical conditions for in-depth analysis of illegal land use in different parts of the country.Based on the 2014-2016 law enforcement inspection data,this paper takes W City of Zhejiang Province as the object of study where the urbanization and industrialization develop rapidly.It first summarizes and analyzes the quantity,performance and trend of illegal land in the city,and then analyzes the causes of illegal land use.Finally,it puts forward some feasible countermeasures to curb illegal land use.The study found that the proportion of illegal land use in new urban construction land has been decreasing year by year in W City,and the number of illegal land use shows a sharp decline,whether it is the total number of plots,or the total area,involving cultivated land area.From the point of view of illegal land use type,the illegal land of public welfare class and special land use has increased;homestead illegal land use has declined,but the proportion is still high;commercial,industrial and mining storage illegal land has dropped substantially.The reasons include:There are many kinds of illegal subjects,such as government,village committees,individuals,enterprises and others,which make the illegal land use hard to prevent;There are many problems in the current laws and regulations,land and resources management system,law enforcement surveillance system and government performance concept;The resources of law enforcement supervision are inadequate and the procedure of law enforcement is complex and the strength is insufficient,moreover,the long-term management mechanism and the common responsibility mechanism have not worked;The land and resources departments lacks the enforcement right.The separation of adjudication from enforcement system in W City is not perfect,besides,confiscation of class and special illegal land use is difficult to implement in place.Finally,this paper puts forward some countermeasures and suggestions to curb illegal land use in W City:Firstly,in consideration of the interests of different illegal subjects,we can take different approaches in order to prevent the emergence of illegal activities from the source.Secondly,we should improve land management laws and policies to increase the maneuverability of land law enforcement and supervision work.Thirdly,we should reform the law enforcement system of territorial resources department,so as to strengthen the system guarantee of land law enforcement supervision.Finally,improving the administrative penalty execution system to ensure that illegal land use cases can be truly implemented.
