Research On The Land Expropriation Procedures Of Our Country

There is great demand for agricultural land with the development of economy and promotion of urbanization. So it is inevitable that agricultural land be levied to satisfy the needs for economical and social development, which makes China as a country that levied land frequently. But the peasants’rights and interests suffer huge damages because the present legal system is imperfect and local government manipulate illegally in drive of benefits. At present, concerning the land expropriation are heated and popular topics.The just procedures are bases of entities. Actually, in the resumption of rural land the peasants’rights and interests are seriously infringed and irresistible. To prevent the expropriation authority from abusing the power of land expropriation, scientific and just procedures are indispensable. So, this thesis, focusing on the procedure, to describe our country land expropriation procedures through the following three chapters. The first chapter discusses legal value about land expropriation procedure, then describe the concept of land expropriation, particularity analyzes the concept of land expropriation procedure, in the end, analyze the development of land expropriation system of our country. The second chapter commentary on the current situation of Chinese land expropriation procedures. This part first commentary on the current situation of Chinese land expropriation, then pointed out the practical problems existing in the land expropriation process and analyses the cause of unnaturalness. The third chapter combines the relevant law of land expropriation and introduces the land expropriation procedures in USA, France, Canada, Japan and Taiwan etc, comparing their characters. Then a serial of suggestion were discussed to improve our country’s due process of law system about agricultural land acquisition.
