The fairness of education right is a basic right to ensure every citizen has the equal education right and receive good education. Since2000, our government has issued many policies and measures to protect the school-age children’s education right of the compulsory education stage from several aspects such as the faculty quality, the education gap and the finance input etc. However, as the affect of the different of different places, China’s current education fairness and justice realization level can’t meet the public’s reasonable needs for education right’s fairness. In order to protect the citizens’basic human rights, conducting in-depth research of school-age children’s education right’s region differences of the compulsory education stage has extremely important theoretical significance and practical significance.From the perspective of the children’s education right’s regional equity, based on a lot of field researches of three city in Shanxi province, using AHP--the method which combines the qualitative analysis and quantitative analysis in operational research, this research aims to study the realization level differences of school-age children’s education right of the compulsory education stage in thethree cities of Shanxi province, and to make detailed contrastanalysis of the reasons and the influence factors of the regionaldifferences of school-age children’s education rights. The concludeshows that the city of Jinzhong own the best situation of education,and the city of Taiyuan ranks second, but the city of Yuncheng isweaker. This paper holds the view that: economy is just the basicfactor in the realization of school-age children’s education right; theimportance degree placed on education by regional government is thedecisive factor of school-age children’s education right in the region;there is great positive correlation between the protection level ofschool-age children’s education right and the realization level of theeducation right in the region; there is weak correlation between therealization level of school-age children’s education success right andthe realization level of education right. On this basis, the author putsforward the following countermeasures: establish the"province"—level education finance mechanism, improve the level offinancial transfer payment in poor regions; strengthen theperformance appraisal of municipal government’s protection ofeducation right, boost the enthusiasm of the local government; blancethe resourse of education and imorove the education sitation; providemulti-channel school-admission opportunities, ensure that school-agechildren have fair education opportunities fundamentally; improve thefunding system for the poor students, eliminate the influence of familybackground on the education right.This paper is made up of six parts. The first part introduces thereason, purpose, significance and method of this research. The second part is the literature review. After summarizing the relevantresearch results at home and abroad, it introduces the relatedtheories and practice of the education right’s realization level at homeand abroad respectively. The third part is the definition of the coreconcepts. It defines the core concepts in this article, namely"school-age children " and " education right"and so on. The fourth partis about the evaluation index system of education right. It elaboratesthe respective establishment situation of first-level index,second-level index, third-level index and fourth-level index of theeducation right indexes. The fifth part is about education right’s citydifferences. It describes the overall situation of the investigation,carries out the comparison and analysis and arrives at the researchresults and conclusions from the perspective of opportunity right,resources right and success right of the existing index system. Thesixth part is to put forward countermeasures and suggestions basedon the above investigation and analysis result.
