Virtue which derives from the individual morality is a person’s moral character andthe sum of human language, behavior and life attitude. There are both positive virtue andnegative From the perspective and dimension of ecological philosophy, it can be dividedinto positive virtue and negative virtue. Positive virtue is a kind of excellent virtue topursue and rationally implement goodness; it is an ecological attitude towards life.However, negative character chooses individual interests as the code of conduct, anddenies the mutual promotion and inseparable relationship between individual and overall.Virtue and law are of intimate relationship. Virtue decides the behavior of an individual,while law is the rule for action of the social community. They have a commonorigin ethics and the same purpose--individual and social harmony. Either behavior tospread negative virtue or violating the law, will eventually suffer corresponding penalties.Typical representatives of client virtue in civil litigation are negative virtue ofabsolute self-interest and positive virtue of rational self-interest. Negative virtue withabsolute self-interest leads to an imbalance of client’s family ecological system, andrestricts the development of one’s own niche. Rational egoism of virtue is the positiveenergy flow, which concurrently harmonizes one’s own internal ecology and externalecology. Business entity also has the virtue of absolute self-interest.Typical representative of client virtue in criminal action is negative virtue of absoluteself-interest delivering damage without serving one’s own interests. One of the mostimportant reasons which causes the formation of negative virtue is the destruction of socialecological environment. In the crime, absolute ego virtue of crime subject not onlyinfluences external ecological system but also changes their internal ecosystem. The virtuedelivering damage without serving own interests results in a serious imbalance spiritualecology status in itself. Some criminal offences also destroy the natural ecosystem. Thepunishment of law not only aims at person or property, but also at the destruction of theecological. The judgment to these people is actually restrictions on the ecological niche ofthem in a certain time.
