The Predicament And Countermeasure Of Legalization Of Chinese Urban Management Administrative Law-enforcement

Since Chinese reform and opening up, the economy and town urbanization has beendeveloping at an alarming rate, thus the problems of urban management have becomeincreasingly prominent. In order to solve such problems as jurisdiction overlaps, lowadministrative efficiency and law enforcement nuisance，the government has establishedurban management departments all over the country, based on the article16of the "Lawof the People’s Republic of China on Administrative Penalty", which is implementingthe power of the relatively centralized administrative penalty. However, at the beginningof the establishment of those departments, it evokes people·s dispute about its validity.Due to the deficiency in legislation and imperfect system, the phenomena of violentlaw-enforcement and the violent confrontation against laws frequently emerge in reality,which become an unstable factor in the construction of a harmonious society. Whenthese issues are subjected to the highly concern of social public, the urban managementand law-enforcement need to straighten out and normalize the system. Starting with theessence of legitimacy, we should explore the legitimization of urban management andlaw-enforcement from the aspects of improving its legal system, deepeningunderstanding and changing the administrative concepts, strengthening systemconstruction and perfecting social security etc. By analyzing the current status ofChinese urban management law-enforcement legalization, taking Gusu district ofSuzhou as an example, this thesis has made thorough research to the d ilemma and itsinternal cause in terms of four dimensionalities including jurisprudence, politics,operation mode and rights guarantee during the urban management andlaw-enforcement legalization in combination with the theory of legitimacy and practical work. On the basis of the experimental city’s effort, the author of this thesis putsforward some operational and perfective countermeasures in the legalization of urbanmanagement to improve urban management system, accelerate the process of thelegalization and promote the reform of urban management system.
