A Study On The Law Enforcement Discretion Of Urban Management Detachment In D City From The Perspective Of Public Administration

Grass-roots urban management administrative law enforcement is inseparable from discretion.Reasonable use of discretion can make urban management law enforcement flexible and efficient.But every thing have two sides,if discretion is abused,it will infringe upon the legitimate rights and interests of law enforcement objects and lead to unfair law enforcement.Standardizing the use of discretion and strictly controlling the abuse of discretion are of great significance for improving the level of administrative law enforcement of urban management and promoting urban harmony.This paper takes the administrative law enforcement detachment of City Administration of D city as the research object,and adopts literature method,questionnaire survey method,interview method and case analysis method to conduct the research.Three questionnaires were designed to analyze the problems with SPSS data analysis software,and 13 law enforcement officers at different levels were interviewed for supplement,which were further explained in combination with specific cases.First of all,this paper analyzes the discretion of urban management administrative law enforcement at the grass-roots level from the perspectives of law enforcement departments,law enforcement personnel,law enforcement objects and citizens who are not directly related to law enforcement activities.Then,the influencing factors are sorted out from four aspects,namely,law enforcement subject,individual law enforcement,law enforcement object and law enforcement environment.Finally,the paper puts forward some countermeasures and suggestions to standardize the use of discretion of urban management detachment in D city: first,to improve the organization and management.It is necessary to manage legislation as soon as possible and avoid "law enforcement by law",ensure adequate resources for law enforcement,and standardize the procedure of law enforcement and refine the standard of discretion in urban management law enforcement.Also the management should obey Implement the parallel ranks and improve the incentive mechanism and sets up a scientific and effective supervision and evaluation mechanism.The second is to improve the comprehensive quality of urban management law enforcement team.Strengthen the study and improve the awareness of urban management service at the grass-roots level,and carry out targeted training to improve the ability ofadministration according to law.The third is to guide citizens to participate in urban management.The law enforcement process should be fully open to reduce information asymmetry and need to cultivate citizens’ sense of ownership of the city,and also improve citizens’ participation in urban management.The fourth is to create a good environment for law enforcement.They can innovate a new way of urban management and enhance external supervision and pay attention to guiding the positive effect of public opinion;improve the coordination mechanism of co-management and co-governance.From the perspective of public management,this paper mainly tries to study the discretionary power of grassroots urban management in law enforcement by means of questionnaire survey and interview,and the research conclusions are expected to provide references for other similar cities in China in terms of urban management.
