Study On The Legal Problems Of The Environmental Administrative Law Enforcement

Environmental administrative law enforcement is the main method ofenvironmental management, which means the administrative subject of environmentalmanagement take behaviors that could affect the rights and obligations of theenvironmental administrative relative person directly according to the law, and carry outother environmental supervision and management activities. Since the reform, theenvironmental problems become more and more serious with the rapid development ofheavy industry, which has seriously affected the sustainable development of ourcountry’s economy and people’s health. However, there are many problems during theprocess of environmental administrative law enforcement in our country at present. Theenvironment relevant functional departments have behaviors, such as the examinationand approval is not strictly, law enforcement is not enough, supervision of the action isabsent, management is replaced by punishment, supervision is lax etc. The emergenceof these problems is related to the weak legal consciousness of law enforcementofficials and imperfect system of environmental administrative law enforcement in ourcountry. Therefore strengthening the environmental administrative law enforcement andimproving the system of environmental administrative law enforcement become theproblem that need to solve by government.For further research the environmental administrative law enforcement in ourcountry, this paper takes a practical case to discuss the environmental administrative lawenforcement. The environment administrative behavior of Lingshi country town was theobject of the research, the methods of empirical investigations and case analysis aretaken. The status quo, problems and reasons for administrative law enforcementbehaviors in, LingShi country town are analyzed.In order to make the results of the analysis has universality, the problems are foundin case analysis will be extended in this paper. The similar problems in environmentalgovernance of the county are analyzed and summarized, and combine with the actualityof county environmental administrative law enforcement in China, the ideas andcountermeasures to perfect the environmental administrative law enforcement systemare proposed, so as to provide reference line to perfect the system of environmentaladministrative law enforcement in China. In terms of research, this paper begins with the current situation of countyenvironmental administrative law enforcement in our country, the construction of legalsystem of environmental administrative law enforcement and the supervision andcontrol system in our country are researched, through normative analysis and empiricalanalysis. And empirical analysis is used to the analysis of basic status and thedifferences of legal norms, in order to get long-term reasonable governance structureconducive to system of the environmental administrative law enforcement.
