On Criminal Cases Of Minors Social Survey System

As the new Code of criminal procedure conducted special chapters to stipulate the juvenile delinquency, it means the progress of our juvenile justice. However, juvenile justice of our country is still in the preliminary stages of development. As the system of social survey in the juvenile criminal cases, although lots kinds of provisions have been stipulated in related laws, it still has a wide variety of shortage, especially in the process of practice, the social survey system can’t achieve the desired effect because of its lack of strictly and specific provisions. Based on the contradistinction to the social survey system in juvenile criminal cases in other country and the understanding of purpose of adjudication in juvenile crime, this paper give some suggestions on social survey system in juvenile criminal cases in our country. To our social survey, we can’t just focus on the reference function of social survey in the process of convicting and sentencing to minors. We must focus on its exhortation function in educating the minors. Put the social survey of juvenile criminal on the view of redressing minors making sure that we can make the right adjudgment legitimately and impartially so that we can really redress the minors.
