Research Of Social Survey System In The Juvenile Criminal Cases

Nowdays, our society gives more attention to the juvenile criminal problems. Because of the particular of this group, it is a necessary requirement of the law that making a distinction between juvenile criminal cases and adult criminal cases. Over the years, educational, reformative, helpful orientation to the juvenile delinquency of China’s criminal law and criminal procedure law achieves public recognition. Specially mentioned here, social survey system what is considering the particularity of the minor crime and useful to protect juvenile delinquents’ rights, added into the juvenile criminal cases proceedings of the amendment of Criminal Procedure Law of the People’s Republic of China passed in2012.However, the new law does not drive the judicial practice so far. The reality is that our social survey system has a lot of problems and controversies in the process of actual operation. Based on the judicial practice, I want to find what aspects of defects in China’s social survey and analysis the basic theory of social survey system. Also, through the comparison of the approach in the social survey procedure between our country and foreign countries, I want to give some useful advises to perfect our juvenile criminal social survey system. The thesis consists of four parts:The first part, introduced by the Li’s case, it is showing the implementation of the social survey system and revealing the causes of social surveys’incompletion.The second part, this part study the basic points of subjects, content, legal attributes, intervention time in the social survey system.The third part, with using the comparative study method, I want to introduce the way of foreign countries’ social surveying and put forward experience worthy of learning.The fourth part, this part conceives a blueprint to perfect the social survey system in our country with refinement of social survey system from the law legislation and establishment of effective coordination in the judicial system, and training professional social investigators and so on.
