On The Establishment Of Legal System For Food Safety Risk Prevention

In recent years, food safety accident occurs frequently, which threatens consumers’ health and life seriously. As a result, people doubt about the effect the food security system basing on traditional legal liability. Some unlawful manufacturers and dealers take risk to produce and sell unsafe food for their own benefits. Because of the imperfection of food safety legal system, the department in charge of this issue usually gets involved after accidents take place, lacking of prevention. Furthermore, consumers have to accept compensation after falling victim to food safety accident rather than under efficient prevention. Therefore, current food safety situation urges an establishment of legal system for food safety risk prevention. Since food safety concerns consumers’ health and life and society harmony, sociologists and law scholars has done research on it. However, existed researches are focused on monitoring, legal liability, legal remedy and so on, and researches on food safety risk prevention are very limited. Therefore, it is meaningful not only for society but also for theoretical significance to research on the establishment of legal system for food safety risk prevention.This thesis is divided into three parts as following:The first part shows the imperfection of legal system for food safety risk prevention in China, and the results it leads to. We also discussed about the main reason why food safety risk prevention is lacked in China in this part.The second part is to explore the experience of food safety risk prevention experience abroad by researching on Japanese and European legal system for food safety risk prevention. Despite the diversity of legal system for food safety risk prevention, there is a lot of experience we can take in. These inspired experiences are helpful to improving the legal system for food safety risk prevention in China.The third part mainly discusses about how to establish the legal system for food safety risk prevention. First, we analyzed on the principle we need to follow. And then, we discussed about the contents of how to establish the legal system for food safety risk prevention. Finally, we discussed about the legal liability of breaking the law of food safety risk prevention.
