The right to education is a right of citizens guaranteed by the state. it is a basic and guaranteed human rights that recognized by the Constitution.Only citizens of a country to receive education will improve the overall quality of personnel provide personnel support for the innovation, narrow the differences between urban and rural education, regional, national.it also could enhance the political enthusiasm of citizens to participate in social governance. So, the right to education is the foundation of other rights,only to achieve the equal right to education, other rights can be truly realized.To promote educational equity is a important concept that repeatedly emphasized by the government and minority candidates in remote poverty-stricken areas could enjoy equal access to education in that case.The implementation of preferential policies for ethnic minorities has taken discrimination problems on the minority in China history into account.Because of the long-term historical change process of minority unfair continuation and the difference of economic development level between the eastern and western regions existing,education resource distribution highlights the serious unbalance development.according to national equality and Preferential treatmets theory,preferential policies for?minority examinee college entrance examination is implemented in our country. this theory can not only let "the compensation to ethnic minorities"and "ethnic minorities students exists in colleges " policies take into effect but also fit equity principle. In recent years phenomenon that the immigrants for college entrance exam occur frequently,minority area students are always discriminated in college enrollment educational inequality caused by bonus policy to minority area lots of parents charge these problem on Preferential policy to minority and consider that this policy discriminate Han people to some degree this is unfair and also against the constitution. Scholars has different opinion on Equality of education and problem still in discussion. all the phenomenon makes new demands on immigrants.The imperfection of preferential policy and education system leak existing lead to being questioned the constitutionality on this policy. Consequently, the implementation of preferential policies for ethnic minorities should treat seriously and improve gradually.This paper studies equality right of education,fully analyze current status of the implementation of preferential policies for ethnic minorities and have a deep explore on immigrant phenomenon, unfairness on preferential policy and regional descrimination.it also give a valuable countermeasures and suggestions on how to perfect the preferential policy in the end. There are four parts on this paper except for the introduction,concluding remarks and acknowledgments. The first part,make theoretical analysis on minority education equality and discrimination, its meaning and theoretical basis, and analyzes from the value orientation education fairness, politics and national unity and the development of society and economy value of minority bonus preferential policy legitimacy,The second part, mainly introduces the current minority plus preferential policy of our country from two aspects the contents stipulated by the law and policy, and put forward the dispute and challenge to the policy, based on the four stages of the evolution history of the preferential policy of minority. The third part, provide systematic analysis on current status of the implementation of preferential and problems that exists. The author take QingHai for example, provide current education status and relevant statistical data to support my point. The last part is mainly on how solve the problem,offer a reasonable Countermeasures and suggestions to improve the preferential policy and reform cultivating mechanisms on ethnic minority.
