The right to education is a basic and critical human right for human existence and development. It has been in the spotlight of international human rights group. Many legislations on the right to education, along with regulations to protect such right, have been enacted and provided to participating nations for reference or enforcement. In the legal society of China, there has been increasing attention devoted to the right to education. It is a constitutional right of citizens. In addition, equality is a foundamental principle of the Constitution. Consequently, the right to education, in the context of equal Constitution, should have equal access for all people in China. Nonetheless, the implementation and protection of the equal right to education in China are not satisfactory. There are significant instances of inequal access to education and discriminatory treatment by the current education system. These instances warrant attention and resolution from legal practitioners in our society. The purpose of this paper is to discuss, from five aspects, the connotation of the rights to equal education and its protection in the context of the Constitution.
