Our country network shopping market has developed extremely fast and trading size has enlarge in double, more and more consumers involved in the network shopping. Consumers through the network bring more convenience to their lives, at the same time, some online shopping disputes may inevitably emerged, such as the seller to provide false information, the seller does not delivery goods. In front of the network shopping disputes, how to regulate the network market, promote the healthy development of the network transactions, maintenance of network consumer’s legitimate rights and interests has become a problem to be solved.This paper first analyzes the violation of consumer rights and interests in network shopping type. By analysis of the safety of the consumer, the right of privacy, right to know, the fair trading right, the infringement right to explain the reason. Then analysis the causes of the network shopping consumer rights damaged. The particularity of network consumption is the deep reason of legal remedy. The network information asymmetry occurred more often in consumption, and consumers’rights and interests are more susceptible to damage. At the same time, imperfect legal system, lack of the remedy mechanism and inequality between the consumer and business are the main cause of online shopping rights difficulty. Overseas legislation experience and enlightenment is a reference to our country. The European Union, the United States, Germany, Japan and other developed countries e-commerce has develop fast than our country, and accumulated a lot of experience, its rules on information disclosure clarity, unconditional cancellation right, online consumer disputes unification under the jurisdiction are powerfully protect the consumer personal interests. Foreign legislation experience can be used for reference, but can not be apply mechanically, it should be fully consider the situation of our country. Finally this paper pointed out that the current law system is poor in protect network consumers’rights, and put forward the perfect suggests. According to the analysis of current network consumers’ rights and interests protection legislation in our country, found the shortage of the current legislation, and then put forward a perfect suggestion on administrative regulation, self-discipline, the establishment of the network credit system, etc.
