Thinking About The Construction Of Harmonious Society Of University Student Appeal System

With the continuous development of society, college students’management work faces new challenges. How to rule the universities by law and effectively reduce the legal disputes between university and student is a looming problem needed to be considered by college managers. To solve this problem is an inevitable requirement to consolidate the party’s ruling status, maintain legitimate rights and interests of people and promote social harmony and stability. Improving college students’appeal system is of great significance to safeguard the legitimate rights and interests of students, transform educational concept, standardize the order of college management, promote ruling the universities by law and ensure the stability and harmony of colleges.In recent years, lawsuit cases against school from college students appear continuously. On March29,2005, ministry of education promulgated the regulation on administration of college students and made specific provision of college students’ powers and obligations, college students’ appeal system also formally established in our country, which offers a new way of relieving college students’rights and interests protection. New regulations have made clear provisions on main part of appealing, scope, time limit, the jurisdiction, procedure and result processing, etc, in the college students’appeal system. But the improvement of the system also depends on the establishment of a complete student appeal system, the justice of student appeal procedure and the establishment of a competent appeal committee.At present, domestic research in the view of dual subject areas of Marxism and law and construction and improvement of college students’appeal system is less. This paper emphatically focus on the related theory exploration and research from this point of view, combined with theory of building a harmonious socialist society and governing the country by law in the subject of Chinese Marxism to analyze the important significance of improving domestic college students’ appeal system. At the same time, guided by the legal theory, this paper analyze the present situation of domestic college students’ appeal system implementation, compare the advantages and disadvantages of college students’ appeal system in the United States, France and Taiwan to learn the advanced ideas and experience, combined with domestic actuality to conclude the measures to improve the system, and so as to improve the pertinence and effectiveness of college students complaints work.
