In order to adapt to the great changes of global economy situation and militarystructure after the end of the COLD WAR,our army have been on the construction rail of“reduce quantity and improve quality”in the times of peace.To consummate militaryservice system, our country have made many explorations and attempts for years ofmilitary service on the level of law policies. With the situation of “recruitmentdifficult”appears again and again,the lack of the mechanism of select and assessmentcompulsory serviceman and the increasingly prominent contradiction of arrangement inrecent years, the existing compulsory service system in our country have got into newtroubles obviously.So this paper take the existing compulsory service system as the studyobject and points out that it is imperative to deepen the reform of compulsory servicesystem.There are four chapters in this paper. So as to lay the foundation of discussion in thefollowing parts, the first chapter mainly talks about the basic theory of legal regulationof compulsory service system,the fundamental and the develop history of military servicesystem in our country. There are two sections in this chapter.The first section mainlyintroduce the basic theory of military service system, explain the existing legal system ofmilitary service system,the main content of the system of professional work concerningmilitary service and the basic features and military role of military service system. Thesecond section talks about the evolution course of military service system diachronic,fromthe point of the legal regulation course of compulsory service system,changes ofcorresponding right and obligation patterns and the dynamics of the reform of militaryservice system. The second chapter introduces the exposed defects on legal system andpractice progress of the existing compulsory service system in our country,and analysesthe possible reasons which lead to the existing compulsory service system be out of work.By introduce the challenges of times of the existing military system in our country,writerarrive the conclusion that our compulsory service system is in sore need of legal regulation.The third chapter make comparisons about similar military service system of domestic and overseas and the advantages and disadvantages of “new”system of volunteer service and“old”compulsory service system,and enumerate the change of military service recruitmentof the main powerful nations in military to hold the mainstream trend of military servicesystem reforms in the world.the setting of military modernization and informatization,withthe argument in the preceding part of the text,writer come up with a imagine about theintegrated design of the new military service system in our country in the fourthchapter.The imagine concludes that upgrade our army’s professionalism levelgradually,there is a badly need to improve the subject status of system of volunteerservice by the way of legislative.Apart from these,writer also put forward some personal opinions, hoping that I canmake a little contribution to the constructing of military service system with Chinesecharacteristic under the new situation. The opinions are about the main content of newmilitary service system in our country,the setting of military service special rights andinterests protect mechanism,military service responsibility of the subject and the constructof dispute resolution system under the new military service system.
