| Confucianism, Taoism and Buddhism had a profound effect on the ancientChinese society. Confucianism as the “state religion†in ancient China, deeply affectedthe Chinese ancient political, economic, cultural and other fields. Law as a branch ofculture, inevitably influenced by Confucianism. Tang Code is a master of law inancient China, its “reasonably on the ceremony†fill the statute with the colour ofceremony, and ceremony is the discipline of Confucianism. Tang Code makes the lawbooks and ceremony together, and this association continues to the Qing Dynasty.Qing Code based on Tang Code, its content is also largly affected by the Confucianism.In this paper, we will explore how Confucianism infiltrate Qing Code from thelegislative and judicial in the second chapter.Buddhism which is a foreign religion is spreaded from India into China duringthe Eastern Han Dynasty, from the initial rejection, marginalized to the integration ofChinese culture, finally it becomes a part of ancient Chinese culture. In the process ofthis transformation, Buddhism has remarkable influence on cultule, art andarchitecture of China, the law is no exception. In the third chapter, we try tointroduce the “five preceptsâ€,“ten commandmentsâ€,“ten feast day†of Buddhismand other disciplines, we find that it is associated with the Qing Code. This link ismainly manifested in infiltration of Buddhism to Qing Code. This chapter will alsodescribe that how Qing Code manage the Buddhism. Through this chapter we intendto draw a conclusion: although Confucianism which was the mainstream has theprominent influence on ancient Chinese law, it does not mean that Buddhism doesnot have a major impact on ancient Chinese law. The influence of Buddhism onancient Chinese law is not an accident, it is exactly exists, to some extent, it plays anextremely important role in some aspects.In the fourth chapter of this paper, we mainly elaborated the infiltration andimpact of Taoism on the Qing Code. Taoism as indigenous religion in China, as timegoes by, Taoism formed a complete theoretical system and rich content of Taoistprecepts, these have a huge contribution on enriching the ancient Chinese culture. Taoist precepts also had a profound impact on setting the Qing Code. If we ignore theTaoism’s influence on ancient Chinese law and the contribution to the ancientChinese culture, it becomes difficult to see the integrity of Chinese culture. |
