On The Community Correction In China Procuratorial Supervision

The Community Corrections is corresponding with custodial correction. In recent years, with the world execution of social trends development and our country’s laws and regulations related to community corrections have been introduced. So the community corrections applicable in practice will gradually increase. As the procuratorial organs of legal supervision on behalf of the State, it will play an increasingly important role in the Community Corrections. However, although domestic theoretical and practical circles were studied this problem, not in-depth. In this paper, the main problems exist in community correction work as a logical starting point. Through investigation and analysis the five methods of supervision exist in the current practice of social supervision, supervision by the NPC, administrative supervision, the CPPCC supervision of Prosecutorial Supervision, and integrated use of empirical, comparative and other research methods. and learn the theory and legislative practice. Based on the criminal concept of integration of the Criminal Code, it is proposed to build the basic principles and specific efforts in legislation and practice regarding the Chinese community corrections system of Procurator Supervision. In order to improve and make some modest for our community corrections.The paper is divided into four sections, except the Introduction and Conclusion sections.The first part is straight to point the problem of the proposed legislative and operational aspects of Community Correction in China., and to explain our Community Corrections work requires supervision.The second section describes the community supervision, the supervision of the NPC, administrative supervision, the CPPCC supervision and prosecutorial supervision in our community correction. Pointing to the present situation of community corrections supervision.The third part, by analyzing the advantages of the Prosecutorial Supervision compared to other supervision methods and using China’s features of Community Corrections procuratorial supervision to prove the need of supervision and procuratorial organs on Community Corrections.The fourth part, by analysis of the insufficient of the community corrections Attorney supervision system, pointed out rationality and legality principle to improve the Community Corrections procuratorial supervision system.
