Chamber of commerce is not only the product of the market economy development,butalso the product of the change of relationship between government and the society. At the sametime, it is also born to correct the operation failure of both market and government, belongs to "thethird social governance mode". Its inherent non-governmental,non-profit determine that itsexistence and operation process must be democratic and autonomic,especially in modern China.However, a large number of the chambers of commerce in China seem to be sick from its firstborn, is gradually losing its essential characters, and presents a disordered trend ofdevelopment,such as,double administrations of government, more and more administrative, evenmore and more like zombies. The author thought that, the crucial problem lies in the lagginglegislation on the Chamber of commerce, for example,the designs of laws on Chamber ofcommerce are not scientific, not perfect, no systematism, the status of legislation on Chamber ofcommerce is not high enough, the regulatory objects and districts are not wide enough. Suchlegislation situation is not only seriously behind the rational demand of all kinds of economicmain bodies to the Chamber of commerce,especially in consideration of China’s currenthigh-speed economic development, which but also seriously hinders the eager of general public ondemocracy and autonomy which only derive from the civil society and the harmonious society.In recent years, the legislation on the Chamber of commerce calls more and more scholars’interests, and theoretical arguments and realistic conditions are more and more mature. A scientificand perfect legislation on the Chamber of commerce will be vividly issued in the latest future, theauthor in this paper demonstrated the necessity and feasibility of the legislation on Chamber ofcommerce, stated the changing history of Chinese legislations and rules of the Chamber ofcommerce, analyzed that of developed countries, and then analyzed the problems in thedevelopment of the Chamber of commerce. The author put forward the main legislation rules ofthe Chamber of commerce, including the Establishment of Chamber of commerce, the Operationorganizations, the Functions and their limits, Merger, Discrete, Dissolution and the NationalAssociation of Industry and Commerce as a national administer of all other Chambers ofcommerce of China, etc.
