Study On The Legal Regulation Of Governance Of Chamber Of Commerce In China

As an important force in promoting social governance,the chamber of commerce plays a positive role in meeting the diverse needs of its members,maintaining the order of market economy and promoting the healthy development of private economy.However,there are still deficiencies in the governance of the chamber of commerce in China,which seriously affect the sustainable development of the chamber of commerce.Moreover,the chamber of commerce is also faced with the problem of how to realize independent governance after the decoupling reform.Studying the governance of chambers of commerce from the perspective of law can put forward feasible legislative suggestions for the long-term development of chambers of commerce,which is of great significance to the improvement of the governance ability and influence of chambers of commerce.Based on China’s national conditions,this paper aims to find out the deficiencies in the governance of China’s chamber of commerce by sorting out the theoretical viewpoints on the governance of China’s chamber of commerce,and propose feasible solutions for the improvement of legal regulations on the governance of China’s chamber of commerce.By using literature research method,empirical analysis method,logical analysis method and comparative research method,this paper combs the existing theoretical research on the governance of chambers of commerce,understands the problems in the governance of chambers of commerce in China,and realizes the systematic analysis of the basic theories of the governance of chambers of commerce and the comprehensive investigation of the actual operation of chambers of commerce.This paper first expounds the concept of chamber of commerce,and by comparing the differences in the legal nature of chamber of commerce between common law system,civil law system and Chinese legislation,clarifies the importance of chamber of commerce autonomy,further analyzes the connotation and necessity of chamber of commerce governance on this basis,and establishes the analysis thinking of legal regulation of chamber of commerce governance in this paper.Secondly,through discussing the basic theory of the charter of the chamber of commerce,the organization structure and external supervision of the chamber of commerce governance,the basic theory of the chamber of commerce governance is systematically analyzed.Thirdly,through the use of empirical analysis to discuss the current situation of China’s chamber of commerce governance,and the existing problems and their reasons are expounded.Finally,based on the development of China’s chamber of commerce,combined with the relevant measures of national policies,this paper discusses the path to improve the legal regulation of China’s chamber of commerce governance.The chamber of commerce is a non-profit legal person spontaneously established by the business entity,which shoulders the mission of safeguarding the common interests of its members.Its organization and operation and activities must conform to the establishment purpose of the chamber of commerce.Chamber of commerce as a social organization,to realize the common interests of members is its participation in various social activities,the main purpose of the integration of social resources,and the significance of the governance of the chamber of commerce is through the establishment of organizational structure,clear the area of responsibility of the chamber of commerce organizations and strengthen the external supervision,for the specification of the chamber of commerce power operation and the maintenance of members’ legal rights effectively.However,there are some problems in the governance of China’s chamber of commerce,such as the lack of supply of the basic law of the chamber of commerce,the absence of the constitution of the chamber of commerce,the lack of supervision organs and the non-standard operation of internal power,and the imperfect external supervision,which lead to the operation efficiency of the chamber of commerce and members’ rights can not be effectively guaranteed,which is not conducive to the sustainable development of the chamber of commerce.Background,the chamber of commerce in to town government governance the perfection of legal regulations need to be done in many ways,on the one hand,should clarify the legal status of the chamber of commerce in the chamber of commerce in the basic law,the functions of the core of the articles of association and the chamber of commerce,etc,on the other hand should improve the setting of the board of supervisors as soon as possible,to set up the internal responsibility mechanism and strengthen the external supervision system.
