Discussion On The Problems And Countermeasures Of Juvenile Offenders Community Correction

The community correction is executed on the criminals who are less harmful.The penalty is more humane and gentler, which may save more judicial resources, andcan overcome the disadvantages of "cross infection". In the aspect of criminaleducation, the community correct conforms to the value of the concept of HarmoniousSociety of socialism in China and it has more advantages to achieve the purpose ofpunishment.Juvenile offenders community correction has better effect than imprisonmentexecution, and with regard to accepting the community correction, it is morenecessary and more suitable to apply community correction to the juveniledelinquency people compared to non-juvenile crime people. Therefore, including thehighly developed rule of law of the civilization countries, almost all the countrieshave adopted special community correction to juvenile offenders which is differentfrom other criminals nowadays. The United Nations has also held a series ofinternational conferences to give special rectification measures on juveniledelinquency internationally. From the youth perspective, these juvenile offenders arecalling for scientific community correction measures to be rescued. In fact thecommunity correction derived from the west, then transplanted to the whole world, itis mainly applicable to the minors and juvenile, it is the most important part of thecommunity correction system, which plays a decisive role. "The Eighth Amendment of Criminal law" and the newly revised "CriminalProcedure Law" of our country have established the legal status of the system ofcommunity correction. Community correction was officially recognized as a kind ofpenalty to punish the criminal. But community correction especially juvenileoffenders community correction field also shows some shortcomings in practice.Considering the significant superiority of community correction especially juvenileoffenders community correction, it is necessary to find countermeasures to solve theexposed or hidden problems.In addition to the introduction and conclusion, this paper has been divided intofour chapters.Chapter one: The concept and theory of community correction of juveniledelinquency are the main content, the juvenile offenders community correction isanalyzed theoretically, and the concept of community correction and basic theory isinterpreted. Then according to the expression and legal provisions of our country,discusses the theory background of community correction in China and reviews theapplicable object the existing law of community correction. Hereinafter, this papersets up applicable objects criteria of juvenile offenders community correctionaccording to the content of the current draft community correction law, and illustratethe reasons through discussion and cases.Chapter two: according to the understanding of the juvenile offenderscommunity correction, found problems in the existence of social cognition, and thenput forward corresponding countermeasures through the investigation and analysis.These issues include the degree of understanding of juvenile offenders communitycorrection, the degree of attention of juvenile offenders community correction,executive resource allocation of community correction of juvenile.Chapter three: From the juvenile offenders community correction system aspects,first describes the development of our community correction system, then analyzedvarious models in different regions in accordance with the current situation to foundthe problems of social cognition and put forward corresponding countermeasures.These issues include the special rectification system of juvenile delinquency, enforcement authority of community correction, human resources management ofcorrection, community correction system of non-prosecution of additional conditionsjuvenile suspect, criminal record elimination system, community service system andformulation and promulgation of "the People’s Republic of China CommunityCorrection Law".Chapter four: From the juvenile offenders community correction method aspect,analyzes the correct consideration of juvenile crime through the analysis of the causesof juvenile crime, then find the existing problems in the aspect of method and putforward corresponding countermeasures. These issues include the specialization ofjuvenile offenders community correction method, establishing juvenile criminal socialcorrection system, assignment of eligible age correction officer.
