A Research On Legislation Of China’s Cultural Industry

The development of cultural industries in China started late, but in recent years,government has begun to pay attention to cultural industries. The state has adoptedtax, fiscal policy to support the cultural industries’ development. On the whole, thedevelopment of China’s cultural industry is showing a booming trend. However, atpresent, China’s cultural industry legislative level is too low, the legislation is too lag,the legal system is not perfect, resulting in management confusion, the non-standardmarket order, the heavy tax burden of cultural enterprises, the lack of effectiveprotection of intellectual property rights. The management of the cultural industry,not stay in a few simple laws level, but to build a legal system, to providecomprehensive protection and promotion of the development of the industry as awhole.In this paper, by comparing the cultural industries in developed countrieslegislation that foreign cultural industries through legislation to determine theoperation of the market mechanism to determine the industrial policy support topromote the dissemination of traditional culture and other aspects of advancedexperience is worth learning, which proposed to establish a sound legal system ofChina’s cultural industry; China’s cultural industry legislation in the higher levels, andother legal coordination and a moderate advance the principles, to comply with thecharacteristics of industrial development, focusing on the protection of intellectualproperty rights, and to inherit and carry forward the national culture; building thelegal system of China’s cultural industry, the need for specialized the Basic law of thecultural industry, and at the same time improve the promotion of legislation toregulate the industry legislation, to encourage local laws and regulations, so as toimprove the legal system of the cultural industry, cultural industry to the legal systemmore in line with the times required.
