Research On The Legislation Of Cultural Industry Promotion Law From The Perspective Intangible Cultural Heritage

Cultural industry promotion legislation plays an important role in promoting the healthy development of cultural industry.China’s intangible cultural heritage resources are very rich,the industrialization of its development can not only avoid the disaster of the Commons and anti-commons,but also bring into play the cultural and economic value of the intangible cultural heritage.In the context of the comprehensive planning of the 14 th Five-Year Plan,the first year of the smooth transition from overall poverty alleviation to rural revitalization,and the first year of the second centenary goal in 2021,the development of the cultural industry is timely and necessary.In this paper,the draft based on(referred to as "draft")in this paper,studies the related content,and found some problems,mainly is a question of legislative idea,legislative technology problems as well as the legislation content,the problems of the legislation content mainly is financial limitation of fiscal and taxation support,supervision mechanism,defect remedy mechanism set up,and the deficiency of the lack of protection of intangible cultural heritage of productive line.All these problems need to be analyzed closely before they can be summarized from the current situation of legislation and implementation.The author combined with foreign advanced experience,from the sound of non-material cultural heritage protection in our country,further promote the "cultural industry promotion law" as soon as possible,to promote China’s boom of cultural industry development direction,is given for solving the problem of legislative idea,legislative advice technical problems and the legislative content,including content on legislation,suggest that implementation of the cultural industry fiscal subsidy and realizes the dynamic monitoring and supervision mechanism,perfect the relief system,and define the boundaries of productive non-material cultural heritage protection.This paper mainly uses the literature analysis method,comparative analysis method and normative analysis method to analyze the problems of the draft from the perspective of intangible cultural heritage,and puts forward targeted suggestions,in order to make the draft become a law through the legislative process in the later stage.
