Study On Legal System Of Antidumping Sunset Review

In recent years, the embarrassing situation in antidumping sunset review causes China standing on the cusp of the problem. This paper aims to find a way to improve our own antidumping sunset review system from WTO、the EU and the USA.By analyzing the history, the. author reveals the original intention of The Agreement of Antidumping, which is avoiding trade protectionism. After analysis and evaluation, the author points that the sunset review systems in the EU and the USA are more operational because of the detail such as the considerations for possibility judgment. It’s advisable for the EU to take "the public interest" into consideration. And it just corresponds with China’s conditions of setting up a long-term mechanism of consumer demand. Besides, specific review cause and time limit improve transparency in sunset review to some extent.Through comprehensive and comparative study, the author draws a conclusion that China may amend and improve the sunset review system by raising the legislative level、unifying implementation rules, defining sunset review clearly, enumerating the considerations, clearing the time limit for each stage and establishing "the public interest" standard.
