Analysis On The Antidumping Administrative Review System Of Taiwan Region

The purpose of antidumping is to prevent dumping behaviors and eliminate the injury caused to the domestic industry by thus behaviors. However, distortion of trade maybe caused if there is no time limitation on the antidumping measure. Therefore, it is necessary to establish the administrative review system in order to determine the need of continuing the antidumping measure, after the antidumping measure has been carried out for a certain period of time.This thesis has comprehensively introduced into the antidumping administrative review system of Taiwan Region, mainly concentrating on its legislative background, as well as its administrative practice, and this thesis also contains suggestions to the development and perfection of the antidumping administrative review system of Taiwan Region. The structure of this thesis is outlined as below:The Preface demonstrates the motive and goal of this thesis, and summarizes the materials related to this thesis.Chapter One is a brief introduction of the general concept of the antidumping administrative review, which includes the definition and necessity of the antidumping administrative review, followed by defining different types of antidumping administrative review, and distinguishing the concept with antidumping investigation and antidumping judicial review.Chapter Two concentrates on the antidumping administrative review system of WTO, by first briefly introducing the antidumping system of WTO, then analyzing the regulations of the antidumping administrative review system of WTO.Chapter Three introduces the legislative background of the antidumping administrative review system of Taiwan Region,and points out parts of the regulations which are still in need of development and perfection.Chapter Four is an analysis of the application of the antidumping administrative review system of Taiwan Region, and has a conclusion of the characteristics of the administrative practice of the Taiwan Region.Chapter Five compares the antidumping administrative review system of Taiwan Region with the relative system of WTO, and gives suggestions to the parts which need adjustment in the antidumping administrative review system of Taiwan Region.
