U.s. Anti-dumping Sunset Review System And The Practice

This thesis mainly researches on the Antidumping Sunset Review of the United States, which falls into the background of Sunset Reform of WTO Antidumping Agreement. The author indicates that, the purpose of the antidumping is to prevent and remove dumping behaviors, and to eliminate the substantial injury or the threat of injury thus caused to the domestic industry. However, possibly the distortion of trade would be resulted from the execution of antidumping measures without time limit, and no remedy function works any more. Therefore, it is necessary and urgent to establish a review system, under which the antidumping measures should be reexamined, after having been in force over a certain period, to determine the need to continue these measures. After the Uruguay Round, the United States began to set up its antidumping Sunset Review System in accordance with the WTO Antidumping Agreement. In spite of its shorter history in comparison with that of European Union, the substantive and procedural regulations have developed fast and comparatively perfect, providing good references for development of relative systems of other countries including China. On the contrary, the Antidumping Sunset Review System of China remains quite deficient and lags behind the practical necessity. The author hopes, through this thesis, the rough research and analysis of the system of the United States may provide certain guidelines for the development and perfection of that of China. This thesis has comprehensively introduced and investigated into the Antidumping Sunset Review of the United States, mainly concentrating on its legislative background, substantive regulation and administrative practice, as well as the suggestions to Chinese export enterprises to tackle the review conducted by the United States. With regard to the structure, this thesis consists of four chapters besides the Preface and Epilogue.
