| Food safety is one of the most issues to which people pay attention in the world today. With the development of market economy in China,the nationwide problem of food and clothing has been basically solved,and to comparatively well-off level.However,on the one hand,many unscrupulous traders try their best to get the maximization benefit,they ignore the professional ethics,regardless of consumer rights of life and health:fake,shoddy;on the other hand, the food safety supervision departments lack of supervision,and it causes the food safety accidents frequently occur,and consumers lost confidence in the serious consequences.The People’s Republic of China Food Safety Law had been put into force on June1,2009.However,the law does not completely change the food security situation of our country,at the same time,there are almost all scholars concerned about how to produce qualified food,but despise the regulation of the "out-of-date food". So increasing the regulation strength of out-of-date food is particularly urgent and important.This paper is divided into three parts.The fist part elaborates the supervision situation of out-of-date food,and we should take the problem seriously.The second part combining with some typical examples of the out-of-date food problem,points out the problem of out-of-date food in China,and selectiveanalysis from the legislation,law enforcement,judicial and the awareness of consumer rights etc.The third part echoed with the issues mentioned before by introducing the practice of some developed countries,such as:Japan,the United States and so on,and try to draw lessons from them,and put forward the measures to improve based on the theory analysis,application. |
