Research On Problems And Governance Of Administrative Law Enforcement Of Urban Management

With China’s reform and opening up, and the development of the socialist marketeconomy, China’s urbanization process has been gradually accelerating, but as the citymanagement system of traditional planned economy has defects such as too much lawenforcement authorities, duplicated law enforcement, which produced some of thenegative social problems. Since1997, the trial work of the urban management in theadministrative law enforcement reform has been started in Beijing and Shanghai, andgradually popularized to many cities of our country. Urban managementadministrative law enforcement is complying with the development of society and ofgeneration, is also the product of relative administrative punishment. Now it is widelyused after years of trial practice. Although the government took the administrativeenforcement of urban management which initially solved the long-standing problemssuch as the bull law enforcement and the duplicated law enforcement, but due toreasons like the lack of experiences, the imperfection of the law enforcement system,and the complication of social structure, non-rational administrative law enforcementand law enforcement relative’s violent resistance to law have occurred in the processof law enforcement, which becomes one of the important factors influencing thesocial harmony and stability. In this paper, the author unified the theory knowledge,referred to the related books and literature, and made a comprehensive elaboration ofcurrent situation of the administrative enforcement of urban management. The layerof depth, the theoretical analysis from the source of urban management systemestablished, for problems in present reality in law enforcement, puts forward thecountermeasures of feasible thinking according to the cause of the problems, hopingfor making their own in the development of the theory and practice of administrativeenforcement of urban management a modest way.This paper is divided into four chapters. The first chapter is mainly on the briefdescription of the research background, selection theory and practical significance.The author pointed out that the dilemma of law enforcement in city management hasbecome a hot issue in society, and defined the train of thought of research,summarized the existing research achievements, and put forward the innovation pointof this article. The second chapter is about the basic outline of the urban managementdepartment and the law enforcement. The author introduced the relevant concepts from the two aspects of urban management department and administrativeenforcement of urban management, and briefly introduced the operation mechanismand the theoretical foundation of urban management department. In the third chapter,through analyzing of the reality of the law enforcement of urban management, theauthor points out the hazards of law enforcement from social influence, thegovernment image, human factors and so on several aspects, and analyzes the reasonfrom the area of the power, the degree, the legal system, the personnel and the relativeperson of the administrative enforcement of urban management. In the fourth chapter,based on the reasons in the third chapter, the author puts forward his views andconstructive measures to improve the administrative enforcement of urbanmanagement from aspects of the improvement of the procedure and the legal systemof the administrative enforcement of urban management, the innovation of the idea ofthe administrative enforcement of urban management, the gradual improvement of theexternal environment of the administrative enforcement of urban management, andthe improvement of personnel’s quality and the level of law enforcement of theadministrative enforcement of urban management. The conclusion of this papermakes a brief summary.
