With continuous development of information age, network is no longer singleinformation transmission tool, but a virtual society which is different from actualworld. Facing the new field, the academic cycle has not made enough preparationsfor a series of network behavior deviance. Meanwhile, the government is also vacantto handle many new problems. Currently, the researches on network behaviordeviance mainly are only limited to micro-level which conducts standardmanagement on technology or individual, but fails to comprehensively understandthe network order in aspect of network society, causing the introduction of manyspecific measures to fail to meet the actual requirements of network society, and thefinal result is not good. Therefore, the paper considers that we must acquire theinevitable requirement of network society on order state. Only in this way, can weprovide effective guidance for solutions of network behavior deviance.The paper, through evidence case and analysis of network social characteristicsand in light of Hayeks theory, points out that the so-called management absence isonly the superficial reason of misconduct. In contrast, the network whole order is notclearly defined, which is caused by the conflict between the inevitable path ofspontaneous order of network society and current management thought built byforeign theory. This is the deep reason of current network behavior deviance. On thebasis, the paper, in light of current network situation, further puts forward thatspontaneous order is the optimal choice of network social order, and the specificregulation measures of network behavior deviance shall be formulated under theguidance of the order principle.Part I firstly demonstrates that the network has already possessed socialattribute, then explains the definition and characteristic of network behaviordeviance, and, in light of network reality, points out that the evaluation criteria ofmisconduct state shall be used as the basis for analyzing the rationality of regulation. Part II, with an emphasis on the evaluation criteria of misconduct state, analyzesthe cause of network behavior deviance, and further points out that with regard tonetwork behavior deviance, we shall not simply analyze the level that whetherregulation is lacking or not; instead, we shall comprehensively consider the orderstate required by inevitable need in network. In current network society, there arenot only spontaneous order rudiments, but also construction thought of externaldesign. The chaos and confliction of order definition caused that the networkbehavior deviance is not effectively controlled. Finally, the paper, in light of thecharacteristic and current situation of network, puts forward Hayek’s spontaneousorder is the optimal choice of network social order. Therefore, the promotion ofnetwork social order shall abide by the spontaneous characteristic of network orderto the greatest extent.Part III, in light of previous analysis of the trend of network order, analyzes thespecific thought and means of network behavior deviance regulation. The papercomplies with the spontaneous generation of network regulation, and strives to findout, coordinate, and integrate network spontaneous regulation. On the above basis,it concludes the methodology which regards soft control as guiding. Moreover, it alsoputs forward advices on current practical operation means in the following threeaspects: network legislation and its practice trend, technological application and itslegal boundary, network ideology and its guidance of public opinion.
