Friedrich August von Hayek is the main advocate for western liberalism in 20th, in his academic career, his studies has always centered about the spontaneous order in human society. He thinks that the task of the social theory is reconstruction of spontaneous order in the society. Therefore, we can say that the thought of spontaneous order is the key of his whole social theory. Based on this, Deng Zhenglai considers the problem of spontaneous order as "Hayek's life-long problem." However, Hayek's discussion of spontaneous order is very dispersed. At present, the studies of spontaneous order is not very comprehensive, there seems to be some misunderstandings about the thought. So this article hopes to systematically expound the idea of spontaneous order and clarify some misunderstandings. Finally, I would like to objectively evaluate the thought of spontaneous order.The thesis is composed of three parts:In the first part, the author is mainly to descant the theoretical basis of the spontaneous order, that is "necessary ignorance" and "limited rationality". Its goal is to fully understand the thought of spontaneous order.In the second part, the author is mainly to introduce the contents of spontaneous order and clarify the misconceptions caused by the classification of order. Then I'll discuss the spontaneous order from its model, characteristics and the relationship between spontaneous order and organization.In the third part, the author is mainly to introduce spontaneous order and law. I'm trying to expound the relationship between spontaneous order and organization from a legal point. I think its relationship is neither the organization must be running at the basis of spontaneous order, nor most people have misunderstood that spontaneous order do not need the organizations. Contrarily, spontaneous order and organization do always condition each other.On this basis, I think that Hayek's thought of spontaneous order is a complete theoretical system. It has a solid theoretical foundation, and has three conditions to ensure the normal operation of spontaneous order. They are liberty, general rules and competition. However, His thought of spontaneous order is not flawless.
