The Legal Research On Ecological Compensation Of Guangxi Wetland

Guangxi is a province with large areas of wetland resource. It is also one of the main provinces where mangroves distribute wildly in our country. However, due to legal system is not sound enough and the management system disordered, as well as compensation capital insufficiency and over-use to wetland in Industrial and agricultural development, the natural wetland area is decreasing and the environment is worse off, the creature varieties’decreasing which also result in ecosystem function of wetland reducing. So the protection of Guangxi wetland resource and marsh become top urgent. It is an effective approach to slove the problem of Guangxi wetland protection and exploitation through legislation to set up the ecological compensation system for Guangxi wetland.In this article, firstly, the writer delimits the "wetland","ecological compensation" and "wetland ecological compensation". Using the related theory of system ecology, economics, law and philosophy to support the theoretical basis of wetland ecological compensation. Secondly, by studying on the ecological compensation theory/practice/legislation of home and abroad. The writer makes summary of the Ecological compensation successful experience in foreign country and in domestic. Also analysis briefly the deficiencies of legislation in our country’s wetland ecological compensation. Thirdly, based on the current situation of Guangxi wetland resource protection and ecological compensation, to reveal the problems of wetland ecological compensation in Guangxi. It attempts to give suggestion on the Guangxi wetland ecological compensation legislation from these aspect:organization structuring, the subjects and scope of compensation, the compensation standard, the sources of capital and the compensation mode. Furtherly, the writer makes recommendation of the reasonable standard for ecological compensation base on analysing of Guangxi its own economic development status; expounding the detailed realization form of ecological compensation by using the market mechanism. In addition, the writer also calls out other auxiliary ways to effective promote legislation:such as building-up the eco-mark; consultation mechanism’s establishment; government actively guide; value the great importance of NGO and so on. In the last part of this article, basis of the characteristic of Guangxi wetland resource, the writer mainly discusses the way for ecological compensation of wetland nature reserve and wetland park,especially focus on the ecological compensation specific proposal for mangroves wetland.
