Research On The Legal Systems Of Island Environment And Resources Protection In China

China has numerous islands. The islands have the very high resources,ecological andeconomic values which are of great significance to safeguard the national marine rights andinterests. Compared with the mainland, the islands has closed geographical positions andfragile ecological system. In order to achieve sustainable use of island resources in China,in December26,2009,our country has passed the "island protection law ". In order to betterprotect the ecological system of islands and their surrounding waters,"the islandsprotection planning" approved by the State Council of the people’s Republic of China,promulgated formally on April19,2012by the State Oceanic administration.The current legal system of island protection mainly include the followings.Theplanning system of island protection. The protection system of Island ecosystem. Thepayment system of island with on residents.The system of protecting islands with specialpurposes.The system of the supervision and the inspection. But the current systems stillhave some shortcomings, so we should improve them to strengthen the awareness of thepublic and promote the sustainable development of the ecological environment of theislands.By using the method of comparison research, learnig from foreign experience,I putforward the conception of perfecting our country’s island protection system. Theestablishment of island registration system and the system of island using period and thetransfer system have perfected the system of the right to use the islands.Our country canimprove the island nature reserve system by strengthen the management mechanism of theisland nature reseerve. Our courntry can refine the island assessment system by makingclear the principles and contents of island assessment system. Our country can improve theprotection funds system of islands by making clear the sources of protection funds and theuse of the funds. Our country can improve the supervision and inspection system of islandsthrough the coordination of the relationship of the supervision subjects.
