Mineral resources are the basis of national economic development, to some extent isthe embodiment of the comprehensive national strength. More than95%of our primaryenergy and more than80%of industrial raw materials are taken from the mineral resources.Reform and improve the existing Mineral Resources Law legal system is an objectiverequirement for establishing a socialist market economic system, but also to eliminate thedrawbacks of the current management system and truly reflect the specific measures topromote national ownership. The system construction of China’s Mineral Resources has along history and a long history of legal construction process; especially in today’s marketeconomy is driven by the Mineral Resources Law of the People’s Republic of Chinaintroduced in1986. Of the law in1996had made changes, but even if the amended MineralResources Law "can no longer meet the current needs of the economic and socialdevelopment. At that time, China’s economic reform is not perfect, is not entirely based onpublic ownership as the development of various forms of ownership. At present, Chinaenacted the "Mineral Resources Law" Amendment and supporting laws and regulationshave been included in the brewing of all relevant departments and personnel, the NationalPeople’s Congress are many ways for comments. Many experts, scholars and lawenforcement workers have wrote books offer advice and suggestions to amend the existing"Mineral Resources Law".In this paper a total of six chapters, the basic theory of Environment and ResourcesLaw, drawing on the view of some experts and scholars on the basis of, in conjunction withtheir study and practice, review the course of the construction of the legal system from theMineral Resources Law. An overview of the existing mineral resources system, and thus theimplementation of the current Mineral Resources of the current situation and problems,Summarizes the characteristics of the current Mineral Resources Law legal system, and therole for the entire mining industry, but also see the lack of system in the implementationprocess, Relatively mature through the introduction of foreign distinctive MineralResources Law legal system can learn from, and ultimately improve the current MineralResources Law legal system, the theoretical analysis. The times, and integration into theinternational resource market to improve the legal system of China’s Mineral Resourcesrecommended for the reference.
