Government plays an irreplaceable role in improving socialist market economy, as well as establishing and maintaining good market roles, establishing fair and strict deal roles, improving market competition at large, guarantee exchange trade information. So the difficulties of Government are how to transform the market access、guarantee the safety of deal and realize the amply competition.This thesis is intended to introduce the status quo of unlicensed operation in Shanghai in its latest developments. It starts with the consequences of unlicensed operation during the period of 2004 to 2008, and then summarizes the characteristics of unlicensed operation in respect of people structure, sector distribution, business venues, area distribution, subjective elements, etc. What lies behind unlicensed operation are social problems, market access systems, and follow-up supervision and administration. Judging from the developments in unlicensed operation in Shanghai, this thesis concludes that the root cause thereof is the scramble for business rights among individuals, and the unmatched proportions and allocations of rights and powers in business fields between governments and individuals. The only way out is to transform market access, and follow-up supervision and administration. How far does the government tackle it? Firstly, the focus is put on market access. This thesis attempts to identify the origins of business rights and business access powers theoretically, and finds that the struggle between these two is the best way to balance rights thereof. Moreover, it specifies the targets and measures regarding market access transformation in recent years. This thesis proposes that the problem behind market access transformation is that business rights among individuals are undermaintained while market access powers are just overestimated towards efficiency. Secondly, the emphasis is laid on follow-up supervision and administration. The conventional government supervision and administration mode is analyzed in view of subjects, modes, object and processes in this thesis. And the case of unlicensed operation in Shenzhen is the highlight for the recent developments of follow-up supervision and administration in China. Lastly, the emerging problem is the lack of the governance and supervision mechanism in this regard.The practices of overseas governments are cited to compare with China’s practices in the governance of unlicensed operation. For instance, the American market access system is a sound one, comprising short-term and long-term business licenses. The businesses with high mobility must fill in origins of goods when applying for business licenses, which guarantees complete business rights and secures business activities for them. In Hong Kong, follow-up supervision and administration is conducted by means of specific supervision and shock actions, apart from favorable funds and booth displacement. In this way, the unlicensed operation is checked in quantity and in its influence in traffic and public sanitation.A series of solutions are proposed upon the above mentioned analysis. First, this thesis proposes that categorized governance is the best of strategies and solutions. Second, the principles and measures are specified as such.
