The transfer behavior can not beprotected by the law, which will inevitably lead to huge circulation costs. Because ofthe contradictions between the reality and the system, China has gradually set up anumber of experimental units for the circulation of rural collective construction land.And it begins to reform the system of the circulation of rural collective constructionland across the whole country now.It is the circulation of rural collective land at the city of Qixia emergedspontaneously under this situation. And it is inevitable to produce related problemsunder the defective legal system. The paper selects Qixia City as the research object,which is one of the innovations of the paper. At the same time, the paper researchesthe current situation, influencing factors and related problems of the collectiveconstruction land circulation at Qixia City. And finally, the paper proposesfundamental solutions to work out the problems in order to promote the land circulatelegitimately and to protect the arable land.Firstly, the paper uses the method of qualitative analysis combined withquantitative analysis to research the influencing factors of land circulation from allpoints of the natural, social, economic and institutional in order to identify the maindriving force of its circulation. The study concludes that the development of township enterprises and the improvement of farmers’ income are important factors to promotethe land circulation. The faultiness of land policy and social security system is theinhibited factor of the land circulation. It is chaotic and costly that the circulation ofcollective construction land at Qixia City. But the relevant policies are reforming.More and more factors promote the land circulation. And it is inevitable for thecollective construction land at Qixia City to circulate generally. Secondly, the paperresearches the land circulation by means of consulting related literature andinvestigations. It finds out that there are a lot of problems during the land acquisition.The problems include destroying cultivated land, following an unbalanced procedureand supplying low compensation for farmers. It is very unreasonable of thedistribution of circulation profits among the country, collective peasant and individualfarmers. The organization of collective peasant and the original land users can notshare the huge value-added benefits of land use. The benefits that the organization ofcollective peasant obtains by its ownership are not used for the resettlement offarmers and rural construction, but mainly for personal misappropriation. At the sametime, the profits transferred by land users are largely acquired by the users. But theprofits that the country should share disappear seriously due to the absence of theregulatory regime. During the land use process, the cultivated lands are reducedlargely. And the efficiency of land used by township enterprises is very low. Thecontinued increase in demand for residential lands and the high urban land pricesmake the construction of real estate at villages of Qixia become popular. But the ruralreal estate is illegal. So it is not protected by low. Finally, in order to work out theproblems of land circulation, regulate the circulation behaviors and protect peasant’interests effectively, the paper proposes relevant proposals from the fields ofreforming the land requisition system, developing related laws for the circulation ofcollective construction land and distributing the circulation profits rationally.
