With the economic development of china and the deepening globalization, theSino-US trade friction has become more prominent, within which, the intellectualproperty turns to be the core arguable issue. For the past few years, the United Statesfrequently focus on China’s IPR protection, on the one hand threaten to impose tradesanctions on China, on the other hand set barriers in Sino-US trade. Both of this hadseriously affect normal economic and trade exchanges between the twocountries.Based on discussion above, it is urgently to conduct in-depth research ofrelationship between intellectual property and China-US trade, so that policy basis ofChinese development process of international trade can be provided.First,this thesis defined the concept of intellectual property,and described Sino-USIPR disputes and the current situation of Sino-US trade.Secondly, analyzes thetheoretical relationship between the intellectual property rights and Sino-US trade。Then,after calculate the level of China’s IPR, employ dynamic panel data model forempirical analysis.Finally, summarize the results of empirical analysis and to makeappropriate policy recommendations.Empirical analysis shows that: On the one hand, the level of IPR protection inChina has gradually increased, but,there is a gap between legislation and enforcement.Hence, our government should improve legislation level of intellectual propertylegislation as well as actively strengthen enforcement of intellectual property rights.On the other hand, a significant positive correlation exist between China’s IPRprotection extent and imports from the United States which indicates that in the longterm, strengthening of Chinese IPR protection is advantageous to both expansion ofSino-US technical exchanges and improvement of the Chinese trade environment. Asa result, strengthening intellectual property protection should be considered as along-term policy to adhere to.At the same time, trade liberalization, market factorsand the quality of human capital factors have a significant role in promoting China’simport from USA,which is consistent with theoretical expectations. As a result,strengthening intellectual property protection should be considered as a long-termpolicy to adhere to. Finally, this paper holds that either excessive or lackingprotection of intellectual property protection is detrimental to the future of Chineseeconomy. Instead, under the premise of following the WTO rules and fulfilling corresponding obligations of intellectual property, China should steadily and orderlyenhance the protection of intellectual property level in light of its own nationalconditions.
