China's Land Expropriation Compensation System Research

Land is the most important production material of farmers and life. Since its founding, however, the dual economic system, agriculture has always been in the supplementary position of industry, the persistence of prices of agricultural products "scissors" damaged a lot of the benefits of farmers. But with the speed of China’s urbanization continues to accelerate, the demand for land is increasing, farmers last piece of land to be levied, and the compensation granted by the State is low enough to maintain its survival and development, which is more for farmers a kind of exploitation, which led to the contradiction of the Government and the people growing. Therefore, the correct handling of this matter has important theoretical and practical significance, the same time; we must seize this opportunity to give and to guarantee farmers a truly dominant position.Using a combination of static and dynamic analysis, contradiction analysis, comparative research methods, and empirical research conducted in-depth analysis of China’s land expropriation compensation system.This article is divided into five parts, the first part is an introduction, including the research background and significance, the research status at home and abroad; second part of the brief land acquisition compensation of the theoretical basis, including the related concepts in land expropriation and compensation theory and principles. The third part describes the course of development of the compensation system and the current status of China since the founding of the land expropriation, the course can be divided into three stages, the status quo, including the current system of regulations and social situation, thus leading to below the problems and causes. The fourth part, from the principle of land expropriation compensation system, the scope, standards, methods, allocation point of view, summed up the current China’s land expropriation compensation system defects and drawbacks, and to grasp the basic contradictions of our farmers on the basis of analysis of land the root of levy compensation system is flawed, because China’s current land system is unreasonable, and buried with the deprivation of the rights and interests of farmers; is the government position in the collection process unreasonable deprivation of the interests of farmers, according to the double identity of the referees and athletes. The fifth part, based on the current situation of China’s land expropriation compensation system, a clear understanding of its defective because the basis on improving China’s land expropriation compensation system targeted to make some suggestions, including the relationship of rationalize the land rights in the Constitution add a "fair compensation" principle of compensation for expropriation, to broaden the land acquisition compensation range, and improve the standard of compensation for a wide range of land compensation for resettlement, reform of the compensation distribution management system. New insights of this paper is that widespread land expropriation compensation, based on the principle of public ownership, standing on the main position of the farmers, from a deeper level of the land system and government implementation level to find the root of the problem and propose solutions, and on this basis program, both the future vision of the system, there are currently feasible to specific programs.
