The internet, for its openness, universal access, digital advantage, real-time interaction, has become a significant channel for the Chinese people to achieve freedom of speech. Meanwhile, the internet, as a double-edged sword, also makes it easier for harmful speech to spread. In this era of the internet, which is more important, the individual freedom of speech or the rights of others or social interests? The question is, however, not about an either-or decision. The internet environment has brought about urgent issues like how to define freedom of speech, whether the government should intervene in its network information administration and how to balance freedom of speech and the government’s information administration. This article begins with analysis of the value and protection of freedom of speech in the environment of the internet. After discussing the justification of governmental regulation of individual freedom of speech in network information administration, the author analizes protective measures for individual freedom of speech in the present Chinese legal system and some problems concerned, in the hope of figuring out one best way which can protect the individual freedom of speech and, at the same time, safeguard a stable social order and national security. This article is divided into the following parts:the Introduction discusses the significance and threats of internet development for citizens to exercise their freedom of speech thereby the necessity of governmental protection and regulation of freedom of speech on the internet through network information administration. Chapter 1 talks about such concepts as freedom of speech, speech on the internet and the value of protecting freedom of speech on the internet. Chpater 2 discusses possible negative effects of speech on the internet and points out that freedom of speech on the internet is limited and appropriate regulation is necessary. Chapter 3 discusses regulations of American and German governments in terms of network information administration and compares their different applicable conditions and characteristics. Chapter 4 mainly talks about relevant Chinese laws and regulations especially present legislation and problems. Chapter 5 discusses how to enhance and perfect the Chinese legal system in respect of the governmental network information administration, namely, cautious positioning of the government, principles of legal application, special legislation and so on.
