At present, China has entered a period of social transition, economic structure transform to a market economy, social structure and the mechanism is undergoing a comprehensive transformation. As a result of a market economic system, the system of units disappeared, the community system formed, social problems are concentrated in the community. We must face the problem that how to effectively resolve various contradictions and disputes in the community. In this paper, I hope to study the basic unit of the city-the community, to found an effective way of community existing private dispute resolution mechanisms, and learn from traditional Chinese culture to provide feasible suggestions for such as reshaping the urban community’s civil mediation mechanism, and to provide feasible suggestions for the community civil mediation of this social management with Chinese characteristics to find a way out.First of all, the concept of civil mediation is defined in this paper. Thus I distinguish between the concept of "civil mediation" and "people’s mediation". Then I analyzed the reasons for flourishing of the civil mediation in the traditional society. I Found that the reasons for the flourishing of civil mediation is a traditional society, agrarian peasant economy as the basis of family values, economic conditions and traditional culture for the people’s thinking and behavior constraints, and institutional pursuit of non-litigation. In contemporary society, the traditional culture has been abandoned, and Western values affect people’s lives. Due to economic restructuring, the traditional unit system is broken, civil mediation decline. Civil mediation did not completely disappear in some areas, civil mediation assuming new forms continue to play a role. After studied some urban communities’civil mediation system, indicating the need to reshape the system of Community civil mediation, I provide some suggestions for how to solve the problems in community civil mediation system and how to rebuild the community during the transition period of civil mediation system. I hope that we can achieve community self-management, self-service, self-monitoring through the establishment of community civil regulatory system with characteristics of modern society development, and ultimately to advance the building of a harmonious society. |
