| As a rule of law, the decisive factor in promoting the process of building the rule of law only in the public domain if the rule of law is not enough, the rule of law should also include civil society, the rule of law should also include civil society. It is a special field which regards the private activities and private social relationship as its core contents and contains the beliefs, values, ways of thinking and attitude which are consistent with the preceding core contents. Consequently, we can conclude that the civil society is the source of the rule by law. In view of this, the construction, development and prosperity of civil society is crucial for Chinese ongoing construction of rule by law. In a sense, the process of the rule by law in socialist China is a process cultivating a mature and perfect civil society. At present, China has established an aim of socialist democratic politics construction, namely establishing the socialist country ruled by law, thus cultivating mature civil society will be the specific performance for China to realize it’s the rule by law in socialist veritably.The first chapter is the summary of the theory related to the civil society. It involves the basic connotation and historical context of civil society, analysis logical relationship between civil society and rule by law in socialism and so on.The second chapter mainly analyzes the rise and the formation of the civil society in the world constitutional history using the method of comparative study, and explores the deep historical origin of western government by law in order to absorb western successful experience for providing reference to the development of Chinese civil society.The third chapter mainly uses historical analysis method to research the relationship of civil society and the construction of the rule by law. In this chapter, the author mainly analyzes the situation that Chinese construction of rule by law faced the condition without the related social basis because China lacked civil society as the important soil for Chinese rule by law during the period which starts from the rule by law movement of the late Qing Dynasty. The fourth chapter analyzes the present state and current problems on the development of civil society in China. In this chapter, the author mainly applies the method of empirical research and refers the recent theoretical results and the latest data.The fifth chapter studies the status of Chinese current civil society, researches the civil society development trend in the future, and explores the countermeasures to promote the healthy development of Chinese civil society and the development of rule by law in socialist China on the basis of the preceding related basic theory and research. |
