The Municipal People's Congress And Its Standing Committee Research Budget Review Supervision

To examine and supervise budget is a significant legal duty that is entitled to the local people’s congress and its standing committee according to the constitution and law. City is an important level in china’s present system of administrative control. It is the city people’s congress and its standing committee’s duty and support to the government to examine and supervise the budget. Recently people’s congress and its standing committee in the city level has probed into the way to examine and supervise the budget. At present the legal system for the city people’s congress supervising the budget is increasingly perfect and its efficiency is increasingly enhanced. It has achieved a lot.But because of the historical and present problems, city people’s congress and its standing committee’s supervision of the budget is not fit for the social development and public desire. It is necessary to have a further study on it.The first part of this thesis, having the theory of city people’s congress and its standing committee’s supervision of the financial budget as entry point, elaborates the definition, contents and procedure of the supervision of government budget and people’s congress budget, analyses the legal bases, principles and characteristics, which is the theoretical basis of the whole thesis.The second part is an investigation on the developing course of the people’s congress in city level and its achievements.The third part discusses the problems. They include:the budget making of the people’s congress in city level is not scientific; examining and approving becomes a mere formality; budget enforcement lacks frequent supervision; the relevant laws and regulations is not perfect. And the reasons that lead to the problems are analyzed.The fourth part, combining the situation in city level, puts forward some suggestions and countermeasures to strengthen the examination and supervision of people’s congress budget in city level. They include:speed up the revision of laws and regulations on the examination and supervision of the budget, improve the ways to supervise the budget in city level, enhance the ability and standard to examine and supervise the budget.
