The Research On Responsibility System For Administrative Law Enforcement In Highway Construction

Responsibility system for administrative law enforcement in the construction of highwayis the research range of highway administration. To solve the problems of " having law but notbeing obeyed, law enforcement being lax and illegal being impunity” in administrative lawenforcement in highway construction effectively, a legal responsibility system need to beestablished, which contains propelling responsibility system for administrative lawenforcement in highway construction, restricting and supervising administrative lawenforcement in highway construction, improving administrative law enforcement in highwayconstruction. The implementation of responsibility system for administrative law enforcementin highway construction has certain significance to scientific and reasonable development ofhighway infrastructure.Theory and method of Administrative responsibility is one of the basic research methodsof responsibility system for administrative law enforcement in highway construction. Usingthe service and responsibility government theories of administration science and relatedtheories of administrative law, this paper defines the concept of responsibility system foradministrative law enforcement in highway construction, analyses elements，basic principlesand existing problems of responsibility system for administrative law enforcement in highwayconstruction and the causes of these problems.Aiming at the existing problems of responsibility system for administrative lawenforcement in highway construction, based on successful experiences of the implementationof responsibility system for administrative law enforcement in typical industries and abroad,this paper puts forward suggestions and countermeasures containing forming a perfect lawand regulation system, perfecting basic system of responsibility system for administrative lawenforcement, strengthening the responsibility consciousness of the main body of the highwaylaw enforcement for highway construction, standardizing their law enforcement activities,forming an all-round multilevel monitoring system.The aim of implementation of responsibility system for administrative law enforcementin highway construction is to regulate and restrict law enforcement activities of transportationadministrative organs according to the specific requirements of responsible government. Administrative law enforcement misconduct and negligence and implementing responsibilitywith great difficulty both have impact on implementation of responsibility system foradministrative law enforcement in highway construction and even the interests anddevelopment of the whole road construction industry, so the implementation of responsibilitysystem for administrative law enforcement in highway construction is very necessary andpressing.
