Non-governmental lending is an inevitable force for China’s economic development in transition period, in recent years, non-governmental lending is extremely active. However, the controversy surrounding the non-governmental lending problem has not been stopped, where the boundary of non-governmental lending and illegal fund-raising.what’s the difference between non-governmental lending and illegal fund-raising.the discussion booted with Wu Ying case. The legal liability for non-governmental lending is uncertainty on existing law, exacting different standards in practical operation, the data shows, recently, disputes about non-governmental lending was growth year by year, with the increase in disputes, the lack of legal liability system become more obvious. The study of the legal liability of non-governmental lending on the basis of legislative and judicial Practice shows extremely important Practical significance to us at present stage.In this paper cut into the crux of Wenzhou, analyzes private lending and development status of China’s private lending liability system, point out the shortcomings in the current legal liability system of private lending and learn from a few representative areas’useful experience, on this basis to perfect our legal liability system.The paper is divided into four parts. The first part is mainly to define the concept of non-governmental lending, on the basis of the characteristics of China’s private lending market to explain the significance of perfect the responsibility system of private lendingSecond part focus on the current legal liability system, we summed up the problems from civil liability, administrative liability, criminal liability, third part is the international private lending legal liability system comparison. Selected areas of the United States, Hong Kong, Taiwan. Three more representative area to compare, draw a brief summary of these countries or regions development of private lending. focuson analysis of its legal liability system to draw some useful experience. Part Ⅳ combined with the shortcomings of the second part of our private lending liability, put forward specific proposals to improve the legal responsibility system in China’s private lending, refine civil liable to pay compensation, strengthen the administrative responsibility for warning crimination early, improve the criminal responsibility system. to build a harmonized liability system...
