Research On The Legal Responsibility Of Health Food Safety In China

Two thousand and ten, Chinese 12th Five-Year Plan in Food Industry, as one of the key components. The safety of these products has also raised public concern. Based on an empirical study of dietary supplement market of Xi'an City from 2013 to 2015, this paper mainly analyze how the optimized legal liability of Chinese dietary supplements function to ensure the safety of the products.The first part focuses on the general introduction to the study, commencing with the current situation of dietary supplement's safety. The second part, initiated with the survey report of dietary supplement market of Xi'an city, mainly covers the major problems of this industry in terms of its product's safety and legal liability. From the aspects of civil liability, administrative liability and criminal liability, the paper then discusses the status quo and problems to be solved on legal relation and legislation of legal liability system of dietary supplement safety law in China. Before putting forward the feasible plan for optimizing the legal liability of Chinese dietary supplement's safety law, the author makes a retrospect of development of Chinese dietary supplement supervision system and generalizes the practices of America, Japan, Germany and their valuable experience in this field.
